Précis
In a French case brought by the owner of a work attributed to painter Jean Metzinger but rejected by a Metzinger specialist, the French Supreme Court (Cour de cassation) in 2014 overturned judicial precedent and found that an expert’s freedom of expression is an absolute right under Article 10 of the European Convention on Human Rights (ECHR) . As such, an expert is free to refuse to acknowledge the authenticity of a work of art.
