The Minister of Cultural Affairs maintains a “list” of movable and immovable objects subject to restrictions as cultural property.

The Minister places specific buildings on the list as “national monuments” at the request of the Commission of National Sites and Monuments, a municipality, or an individual. (Law of 18 July 1983, Art. 2)

Movable objects “whose preservation is in the public interest” are listed by Ministerial decree. (Law of 18 July 1983, Art. 20-21)

Buildings…whose preservation is of public interest from an archaeological, historic, artistic, aesthetic, scientific, technical or industrial point of view shall be listed by the Government as national monuments in full or in part based on the distinctions established by the articles hereinafter. Included among the buildings likely to be listed under the terms of this law are megalithic monuments and land containing prehistoric locations or deposits. (Law of 18 July 1983, Art. 1)

Movable objects…whose preservation is of public interest from an archaeological, historic, artistic, aesthetic, scientific, technical or industrial point of view, may be listed by Ministerial decree. (Law of 18 July 1983, Art. 19)

Sectors called “protected sectors” may be established and defined by Grand Duchy decree upon the advice of the Council of State when they show archaeological, historic, artistic, aesthetic, scientific, technical or industrial characteristics so as to justify the preservation, restoration, and improvement of all or part of a group of buildings. (Law of 18 July 1983, Art. 34)
